Terms and Conditions
1. Introduction
Welcome to Ozoroa. By accessing our website, making a booking, or using any of our services, you agree to be bound by these Terms and Conditions. These terms govern the provision of vehicle rental services and tour facilitation services offered by Ozoroa, operating within the Republic of Namibia. Please read them carefully before proceeding.
Ozoroa reserves the right to amend these terms at any time. Continued use of our services following any changes constitutes your acceptance of the revised terms.
2. Eligibility & Booking
To rent a vehicle or book a tour with Ozoroa, you must:
Be at least 23 years of age (or 25 for certain vehicle categories such as 4x4 and luxury vehicles)
Hold a valid driver's licence — a Namibian licence, international driving permit, or a recognised foreign licence as required by Namibian law
Present a valid passport or Namibian identity document at the time of collection
Provide a valid credit or debit card in the primary driver's name for security deposit purposes
Bookings are confirmed only upon receipt of a written confirmation from Ozoroa and payment of the required deposit. Ozoroa reserves the right to decline any booking at its sole discretion.
3. Vehicle Rental Terms
3.1 Condition & Inspection
Vehicles are provided in clean, roadworthy condition. Clients must inspect the vehicle at collection and sign an inspection report. Any pre-existing damage not noted on the report will be the client's responsibility.
3.2 Permitted Use
Vehicles may only be driven within Namibia unless prior written authorisation has been obtained from Ozoroa for cross-border travel. Cross-border travel may attract additional permit and insurance fees. Vehicles must not be used:
For sub-letting or commercial transportation of passengers or goods
On roads or terrain for which the vehicle is not rated (e.g., driving a 2WD on designated 4x4 tracks)
For racing, off-road events, or any illegal activities
3.3 Fuel Policy
Vehicles are provided with a full tank of fuel. Clients are required to return vehicles with a full tank. Failure to do so will result in a fuel surcharge being levied at the prevailing commercial pump rate plus an administrative fee.
3.4 Mileage
Unless a specific mileage package has been agreed in writing, a daily kilometre allowance applies. Excess kilometres will be charged at the rate stipulated in the rental agreement.
3.5 Return of Vehicle
Vehicles must be returned to the agreed location at the agreed date and time. Late returns will be charged at the full daily rate plus an administrative surcharge. Ozoroa is not liable for any loss or inconvenience caused by a late return.
4. Insurance & Liability
All vehicles include basic third-party insurance as required under Namibian law. Comprehensive collision damage waiver (CDW) and theft protection (TP) are available at an additional cost and are strongly recommended.
Without CDW and TP, the client assumes full financial liability for any damage, theft, or loss of the vehicle. Even with CDW/TP, the client remains liable for the agreed excess amount specified in the rental agreement.
Ozoroa accepts no liability for any personal injury, loss of life, or damage to personal property arising from the use of a hired vehicle, except where such liability is imposed by Namibian law.
5. Tour Facilitation Services
Ozoroa facilitates tours and travel experiences across Namibia, acting as an intermediary between clients and third-party service providers including but not limited to lodges, game reserves, activity operators, and guides.
Ozoroa makes reasonable efforts to ensure the quality and safety of all recommended service providers but does not assume liability for the acts, omissions, or negligence of third-party operators.
Tour itineraries are subject to change due to weather conditions, road closures, wildlife management requirements, or other circumstances beyond Ozoroa's reasonable control. We will endeavour to provide suitable alternatives.
Clients are responsible for ensuring they hold adequate travel insurance covering medical evacuation, trip cancellation, and personal liability, particularly when undertaking tours in remote or wilderness areas of Namibia.
6. Payments, Deposits & Cancellations
6.1 Payments
All prices are quoted in Namibian Dollars (NAD) unless otherwise stated. Payments may be accepted in NAD or South African Rand (ZAR) at the prevailing exchange rate. Card payments and EFT bank transfers are accepted. Cash payments are accepted at our discretion.
6.2 Security Deposit
A refundable security deposit is required at vehicle collection. The deposit amount varies by vehicle category and will be confirmed at the time of booking. The deposit will be refunded within 7 working days of vehicle return, subject to deductions for any damage, fuel shortfall, or outstanding charges.
6.3 Cancellation Policy
Cancellations made more than 30 days before the rental/tour commencement date: full refund of deposit
Cancellations made 15–30 days before commencement: 50% of total booking value retained
Cancellations made less than 14 days before commencement: no refund
No-shows: no refund
Ozoroa reserves the right to cancel any booking in the event of force majeure, government restrictions, or safety concerns. In such cases, a full refund will be provided.
7. Client Obligations & Conduct
Clients agree to:
Treat all Ozoroa vehicles, equipment, and property with care and respect
Comply with all Namibian road traffic laws, including speed limits and seatbelt regulations
Not drive under the influence of alcohol or any controlled substance
Report any accidents or incidents involving an Ozoroa vehicle to local law enforcement and to Ozoroa immediately
Not smoke inside Ozoroa vehicles — a cleaning surcharge applies if this condition is breached
Respect the natural environment, wildlife, and local communities during tours
8. Governing Law & Dispute Resolution
These Terms and Conditions are governed by and construed in accordance with the laws of the Republic of Namibia. Any disputes arising out of or in connection with these terms shall be subject to the exclusive jurisdiction of the Namibian courts. We encourage clients to first contact us directly to seek an amicable resolution before pursuing formal proceedings.

5. Sharing Your Information
We do not sell or trade your personal information. We may share your data with:
Third-party tour operators, lodges, and activity providers strictly to fulfil your booked itinerary
Payment processors and financial institutions for transaction processing
Government authorities, law enforcement, and regulators where required by Namibian law

Any third parties with whom we share your data are contractually required to handle it in accordance with applicable data protection principles.

7. Data Retention

Booking records and financial data are typically retained for a minimum of five years in compliance with Namibian commercial and tax legislation. Marketing data is retained until you withdraw consent.
